Mr. Carlton has over twenty years of practice.
In the employment area, examples of his work include: advised clients on employee hiring and firing; prepared employee handbooks; prepared employment agreements, including non-competition and non-solicitation agreements and agreements to protect confidential information and trade secrets; represented employers and former employees in litigation related to employment agreements, including non-competition and non-solicitation obligations; investigated sexual harassment claims; provided training to client company employees on sexual and other harassment; represented employers in EEOC and state agencies' proceeding on employee discrimination complaints; represented employer in litigation in federal court on discrimination; represented executives in employment termination and severance circumstances, including negotiating compensation and other benefits in connection with employment termination; advised clients on wage and hour, overtime exempt/non-exempt employee, and independent contractor/employee determination issues.
In the real estate area, work examples include: daily advising of property managers and property owners related to a wide spectrum of property management issues, including leasing, landlord/tenant issues; evictions; landlord/tenant litigation (including bankruptcy court lift stay motions); handling fair housing claims before HUD and state and local fair housing enforcement agencies; vendor contract preparation and review; vendor disputes and litigation; foreclosures; purchase and sale contract negotiations and transaction due diligence and closings; mold claims and disputes. He also represents landlords and tenants in commercial lease negotiations.
In the business entity area, Mr. Carlton advises clients and prepares documents related to formation, modification and maintenance of all entity types and agreements, such as corporate bylaws, limited liability company member agreements, partnership agreements, and shareholder/member/partner agreements related to ownership transfer restrictions. In addition, Mr. Carlton has represented business entities and their owners in connection with purchase and sale of businesses.
In the commercial litigation area, Mr. Carlton has represented creditors in all phases of collection work, including pre-judgment and post-judgment extraordinary remedies of garnishment and sequestration. He has represented clients in numerous contract disputes, deceptive trade practice claims and other commercial disputes.
Publications include columns and articles for Rooflines, the monthly magazine of the Apartment Association of Greater Dallas and Units, the monthly magazine of the National Apartment Association and the newsletter of the Dallas Chapter of the Institute of Real Estate Management.
Presentations include: speaking to several business groups, including the Texas Apartment Association state convention, Apartment Association of Greater Dallas, Dallas Claims Association, Mothers Against Drunk Driving national conference, National United Salon Owners Association, and the Wholesale Dealers Association. In 2006, Mr. Carlton presented the Texas Apartment Association REDBOOK (the legal “bible” of the Texas residential property management business) and legal update seminars to four of the larger local apartment associations around Texas during 2006. This program is presented every other year in Texas. Mr. Carlton is the Dallas area representative (one of five attorneys statewide) on the Texas Apartment Association Council of Legal Counsel.
Interest outside the law: His children; Baseball fan (Mr. Carlton and his son have set a goal to attend a game at all major league ballparks before his son graduates from high school); Rotisserie Baseball participant and champion; Golf; University of Texas sports; College sports in general, including March Madness; Travel; Technology and new gadgets.
